CLAIMS PROCESS

VeteransEveryone who has ever dealt with the VA or a veteran service organization knows that the claims process is a process that takes as long as glue running up a board! So, can I make this process go any faster? The answer is yes and no! No, I myself cannot force the VA to process your claim any faster then they want to. But, I also know that the “squeaky wheel” gets the attention. So, I implore every avenue I can to get the claim processed to the point that either it is awarded or denied. Then, I can appeal it and get it out of the Regional Office and to the Board of Veterans’ Affairs, or the Court of Veterans’ Appeals, both of which are not under the now recently exposed “VA Bonus Program.”

Unlike the various veteran service organizations, I want you to contact your Senator and Congressman/woman. I want you to contact the media and share your story and I want you to be as mad as hell. You earned these benefits, and if you and I don’t get the current situation out to the publics’ attention it will never change for the better!

That being said, yes, I can get a faster response from the VA on your claim process. But then again, is a reduction of 30 days faster than not having a reduction? To me, a year and a half is a year and a half. However, a year and a half plus one is now two years. In any event, my personal opinion is any amount of time beyond 90 days is excessive and any time beyond one year is just criminal. But again, I am not an attorney, this is just my opinion!

and regulations.

Despite the insensitive analogy, I refer the VA process to my clients as a “game,” because it is a game. They, the VA, have the game book, the rules and regulations. They also have an unrestricted ability to change the rules and regulations. The bottom line is that the only legal requirement is for the VA to make a decision. It does not have to be the right decision, they just have too make a decision, period! There is no structured accountability. How can there be when the Regional Office and Medical Centers are operating on a “Bonus Program,” receiving a “Bonus” if they don’t spend the money allocated for that fiscal year? Awards are denied, save $20,000.00 here and there for a couple of years, or deny a couple of $25,000.00 electric wheel chairs or medical procedures and well you can do the math.

So, collectively we have to play the “game” together. In doing so, we put together “special teams.” First picks, we hit them hard, and at half time we regroup and go for the victory pulling out all the stops!

I cannot guarantee that we will win your claim. If I did you would be lied to. If you are looking for someone who can promise you that they will win your claim, then I have some prime underwater land that I would like to sell you for a good price when they win your claim!

What I can promise you though, is that win or lose, the VA will know that they have been in a fight!

We have an email address which is a good tool to ask questions and request checks on your claim status. We are in the process of hiring additional representatives. Our policy is to hire veterans or family members of veterans. We also want you to understand that your claim is our claim. We have a vested interest in getting you every possible benefit that you and your family have earned. Again, we have to work as a team!
